Please carefully read these terms and conditions (“Terms and Conditions” or “Agreement”) as they contain the legal terms and conditions that you agree to when you use the service provided by us through the Website and the App (“Platform”, “Website”).

We will notify our registered members of material changes (if any) to these terms and conditions by either sending a notice to the email address provided when signing up or placing a pop-up on our website/mobile application(s). Be sure to visit this page periodically to review the most recent agreement version.

Introduction

Flashprice is a platform that provides price comparisons, cashback and offers from various retailers and service providers. You agree to comply with these Terms and Conditions by accessing and using our Services.

Membership

Membership on Flashprice is available through a registration process after you submit certain requested information. By registering on Flashprice, you agree to adhere to the prevailing Terms and Conditions.

Please note that members of Flashprice are not allowed to run any paid advertisements on Google, Facebook, or any other platform pointing to Flashprice. Non-compliance with this may result in immediate termination of your account.

Declaration

Your purchases using Flashprice will be used only for bona fide personal purposes. You shall not use Flashprice to purchase anything for resale or commercial purposes. We reserve the right to block or terminate your account without prior notice if we reasonably believe that Flashprice is being used for unauthorised purposes.

Our Service

Price Comparison Service: Our price comparison service allows users to compare prices from various retailers listed on our Platform. We strive to provide accurate and up-to-date information, but we do not guarantee the accuracy or availability of the prices listed.

Cashback Service: Our cashback service allows registered members to earn cashback by purchasing from retailers on our Platform. To qualify for cashback, the retailer must confirm the member’s purchase as a “Qualifying Transaction,” we must receive the resulting cashback. Cashback can be transferred to bank accounts only after reaching the minimum threshold set by us.

Offer Service: Our offer service provides users access to exclusive deals and discounts retailers offer. These offers are subject to terms and conditions specified by the respective retailers.

Becoming a Member

To become a member of Flashprice, you must be 18 years of age or older. By registering on Flashprice, you represent and warrant that you are 18 years of age or older, have the right, authority, and capacity to use the Platform, and agree to abide by these Terms and Conditions.

You must provide accurate and current information about yourself during the registration process. You must also ensure that your contact information, including email address and mobile number, is kept up-to-date.

Cashback, Rewards, and Referral Fees

After a member successfully completes a Qualifying Transaction, and once we have received the resulting cashback or reward for that transaction, we pass it on to the member through their chosen payment method.

Please note that there are various circumstances in which a transaction may not constitute a Qualifying Transaction, or cashback/rewards may not result from it. We shall not be liable for any difference between the expected cashback/reward and the actual cashback/reward received by the member.

Members can inquire about missing cashback/rewards within 10 days from the transaction date. We reserve the right to investigate and reclaim unduly paid cashback/rewards.

Your Account

You can withdraw or redeem your validated cashback/rewards when you have attained the minimum threshold in your account. If your account is closed and the validated cashback/rewards are less than the minimum threshold, the entire amount will be forfeited.

You are responsible for maintaining the confidentiality of your account information and password. We will not be liable for any unauthorised access to your account.

Validity of Cashback/Rewards/Referral/Special Bonus

Earnings on Flashprice will expire unless you log in to your account for a continuous period of 2 years. You must log in at least once every 2 years to prevent expiry. Expired earnings will not be withdrawable.

Intellectual Property

All copyright, trademarks, and other intellectual property rights relating to Flashprice are owned by or licensed to us. You may only copy, distribute, or create derivative works from the Platform with proper authorisation.

By uploading material on Flashprice, you grant us a non-exclusive license to use, reproduce, and distribute that material through our services.

Privacy Policy

Our Privacy Policy forms part of this Agreement, and by entering into this Agreement, you also consent to how we handle your personal data under that policy.

Our Role

We are not a party to any transactions with retailers and are not the seller or supplier of any goods or services. We do not have any legal obligations that apply to the sellers of those goods or services.

Misuse

We reserve the right to suspend or terminate any member’s access to our service if, in our reasonable view, the member appears to be in breach of any provision of this Agreement.

Members must not engage in any fraudulent activity or misuse our service. We reserve the right to forfeit any pending or validated payments in case of misuse.

Contact from Third Parties

If anyone contacts us in relation to material or transactions associated with your account, you agree to provide all reasonable information and assistance we require.

Additional Services

We may offer new or additional services through Flashprice from time to time. Your use of those services may be subject to additional terms and conditions.

Operation of our Service

We reserve the right to withdraw, modify, or suspend aspects of our service where we have legal, security, technical, or commercial reasons to do so. We will endeavour to give you 30 days advance notice before taking such action.

Disclaimer and Limitation of Liability

We provide our services on an “as-is” basis and disclaim all warranties, express or implied. We shall not be liable for any indirect, special, or consequential damages arising from your use of our services.

Our liability shall be limited to direct loss or damage only and shall not exceed the amount specified in this Agreement.

Communication

By using Flashprice, you expressly agree to receive communications from time to time from Flashprice, its affiliates, partners, and third parties regarding the services rendered, important updates, feedback & surveys, marketing, or any other relevant messages by way of SMS, e-mails, calls (automated/ agent generated), WhatsApp notifications, mobile application and browser notifications, or any other medium. You agree and consent to receive communications relating to all of the above and expressly waive any registration or preference made under the DND/NCPR list under the applicable TRAI regulations.

Indemnity

You agree to indemnify Flashprice against all liabilities, claims, and expenses arising out of or in connection with (a) any breach of this Agreement by You or through Your Account or (b) any transaction with a Retailer.

Assignment

Flashprice reserves the right to assign this Agreement and to assign or subcontract any or all of our rights and obligations under this Agreement but will not do so in such a way as to reduce any guarantees you are given under this Agreement. Without our written consent, you may not assign or dispose of this Agreement nor subcontract any of your rights and obligations under it.

Entire Agreement

This Agreement is intended to contain your entire agreement with us relating to the services provided by Flashprice; we believe it to be fair and reasonable. It replaces all earlier agreements and understandings with you relating to Flashprice services, except for any fraud or fraudulent representation by either of us.

Changes to this Agreement

Flashprice reserves the right to change this Agreement occasionally and post the new version on the Flashprice platform. When we do so, we will post the new version of the Agreement on the platform, and the new version of these terms and conditions will take effect and govern Flashprice services and your relationship with us.

Severability

In the event that any term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. You and Flashprice are independent contractors, and no agency, partnership, joint venture, or employee-employer relationship is intended or created by this Agreement. Our failure to act with respect to a breach by You or others does not waive our right to act with respect to subsequent or similar breaches.

In compliance with the Information Technology Act, 2000 and the rules made thereunder and the Consumer Protection (E-Commerce) Rules, 2020, the details of the Grievance Officer of Flashprice for this Agreement are as follows:

Suppose any aggrieved user has any questions or intends to make a complaint regarding any violation of the provisions of these Terms of Use. In that case, they may send a written complaint to the Grievance officer, who shall redress it within 1 (One) month of receiving it. Note: Flashprice, at its own discretion, may modify the aforesaid details occasionally. Providing false, misleading, or inaccurate information to the grievance officer may result in civil and/or criminal liability.

Governing Law

Indian laws govern this Agreement and our relationship with you and each Member. You and we each submit to the non-exclusive jurisdiction of the Indian courts in relation to disputes arising in connection with this Agreement.

Keeping this Agreement

Flashprice does not separately file the individual Agreements entered into by Users when they register for the services. Users can access it at Flashprice.in. Please make a durable copy of this Agreement by printing and/or saving a downloaded copy on your own computer. It is offered in English only.
